Workers Compensation

Comcare Claims

If you have been injured at work and you are employed by the Commonwealth, you are able to claim compensation from your employer.

Compensation can include:

  1. medical, travel and associated expenses,
  2. weekly or fortnightly payments for lost wages,
  3. rehabilitation expenses,
  4. a lump sum permanent impairment benefit for pain and suffering

You can claim all of the above, even if the accident was your fault.  You may be covered by the Comcare if you work for:

  1. The Commonwealth or ACT Government, agencies or authorities; or
  2. Commonwealth Corporations, for example the Commonwealth Bank of Australia, Australia Post and Telstra.

If you suffer injuries which assess at a permanent impairment of 10% or more and the injury happened in circumstances where someone else has been negligent, you may be entitled to common law damages for pain and suffering.

If you receive common law damages your entitlement to receive weekly payments and payment of ongoing medical and like expenses is not affected.
