Weekly Benefits

If you are injured and become unable to perform your normal work duties, you will be entitled
to compensation for lost wages. Matters taken into consideration include:

  • your pre injury average weekly earnings (PIAWE);
  • overtime worked prior to your injury
  • the length of time for which you have been in receipt of payments; and
  • your current work capacity.

 

Weekly benefits are capped at twice the State average weekly earnings. As at April 2010, the maximum weekly rate payable was $1,760.

If you were injured on or after 1 January 2005, your entitlement to weekly benefits is
calculated at:

  • for the first 13 weeks following your injury: 95% of your PIAWE;
  • after 13 weeks: 80% of your PIAWE;
  • after 130 weeks:
  • 75% of your PIAWE if you have no current work capacity and this is likely to continue indefinitely; or
  • if you have returned to working at least 15 hours per week, are earning at least $151 per and are likely to remain incapable of working beyond this level as a result of your work injury: 75% of your PIAWE less 75% of your actual earnings.

After 52 weeks, you are also entitled to superannuation whilst in receipt of weekly payments until age 65.
