How to make a workers compensation claim

If you have been injured at work in Victoria you will be entitled to compensation under the Victorian WorkCover system. This is a ‘no-fault’ scheme. You can still make a claim even if the accident was your fault.

Making a claim may seem daunting and confusing, but we’re here to help you.

Making a workers compensation claim

There are six things you must do to initiate a workers’ compensation claim:

Step 1: See your doctor

Get medical treatment and explain exactly how your injury happened.

Step 2: Report it to your employer

Let your employer know right away. Log it in the injury register or submit a claim form.

Step 3: Gather your documents

Claiming medical costs? Attach your receipts.

Taking time off? Include a Certificate of Capacity from your doctor.

Step 4: Lodge your claim

Get the workers compensation claim form from your doctor, post office, or online.

Give it to your employer – they have 10 days to send it to their insurer. Keep a copy!

Step 5: Wait for a response

The insurer has 28 days to decide.

If it’s rejected or you hear nothing, contact us within 60 days.

Step 6: Contact us for a free consultation

Speak to our experienced WorkCover lawyers – you could be entitled to thousands in compensation.
We’ll handle the process for you and keep you informed every step of the way.

What can workers’ compensation lawyers help you make a claim for?

If we believe the case is likely to be successful, in most circumstances we will pursue your claim on a ‘no win no fee’ basis. This includes paying for out-of-pocket expenses.

Not all Victorian employees will be covered by this scheme. Some employers are insured under the Comcare scheme. For more information please see our Comcare section.

Testimonials

“I would like to say thank you to you and your team on behalf of my mother and me for the positive outcome for Mum’s case.

I know this hasn’t been a straightforward matter, and I appreciate all your efforts and communications over the past couple of years. There were times when I didn’t think we would get anywhere with it, but at least the compensation Mum received will help her out in her day to day life.

I would be more than happy to recommend any friends or relatives to your practice in the future and will contact you if we require your services again.

Once again, many thanks.”
