Comcare workers compensation in Victoria

Comcare is a scheme that provides worker’s compensation for employees of the Commonwealth Government and some national employers. It applies to all Commonwealth employees and many national corporations such as National Australia Bank, Commonwealth Bank, Australia Post and Telstra who are licensed under the scheme.

Unlike the Victorian WorkCover scheme, Comcare is administered by the Federal Government rather than State, although there are similarities in the two schemes. One similarity is a no fault policy which means you can still claim compensation even if you were at fault in the accident.

What can I receive a payout for?

If you were injured at work, travelling for work purposes, or attending work-related activities, you may be entitled to receive compensation for:

  • Back injuries
  • Neck injuries
  • Hearing loss
  • Heart conditions

  • Psychological injury (mental stress)

Comcare Claims

If you have been injured at work and you are employed by the Commonwealth (either full time, part-time or casual), you are able to claim compensation from your employer.

Compensation can include:

  • Medical, travel and associated expenses
  • Weekly or fortnightly payments for lost wages
  • In-home care
  • Rehabilitation expenses
  • A lump sum permanent impairment benefit for pain and suffering

You may claim all of the above, even if the accident was your fault. You may be covered by the Comcare if you work for:

  • The Commonwealth or ACT Government, agencies or authorities; or
  • Commonwealth Corporations, for example the Commonwealth Bank of Australia, Australia Post and Telstra.

If you suffer injuries which assess at a permanent impairment of 10% or more and the injury happened in circumstances where someone else has been negligent, you can make an election to pursue a common law damages for pain and suffering.

If you receive common law damages, your entitlement to receive incapacity payments and payment of ongoing reasonable medical and like expenses is not affected.
