Arnold Thomas & Becker Lawyers are appalled by the high number of horrific allegations being made regarding potentially unwarranted surgeries, including hysterectomies by Melbourne gynaecologist Dr Simon Gordon when pathology results showed no or limited signs of endometriosis.
Below are answers to some of the most frequently asked questions regarding Dr. Simon Gordon’s long history of alleged medical malpractice and unnecessary surgeries:
- Our firm has been contacted by over 250 women who have been treated by Dr Gordon, and have subsequently had invasive surgery which may not have been necessary. We expect more to come forward in the coming days
- Many of the women who have contacted us are in their twenties and have had invasive surgery because they were advised that they had severe endometriosis and needed to have their ovaries, and in some cases their uterus taken out. Some have become infertile as a result of their surgeries
- We have already issued legal action in the Supreme Court for two of our clients.
- Given the number women treated by Dr Gordon, Arnold Thomas & Becker is also exploring the potential for a class action. Individual claims may still be appropriate but we will explore both options and will determine the most suitable approach for our clients.
- Mr Gordon operated on a number of patients at the Epworth Hospital, where it has now been revealed that complaints by other health practitioners had been made to managers at the hospital and we allege that appropriate action was not taken by the hospital.
- It appears that complaints regarding Dr Simon Gordon were made to Epworth management as early as 2022 were not reported to AHPRA until late 2025. We will be investigating why the Epworth took 3 years to act on these complaints.
- APHPRA has mandatory reporting requirements for health practitioners and employers of practitioners, so an important part of our investigation will be to understand why there appears to have been a delay from the Epworth with their reporting regarding Dr Gordon
- Other Gynaecologists who have reviewed patient records and pathology reports have indicated that many of the surgeries performed by Simon Gordon were, in their view, unnecessary and in some cases, caused “more harm than good”, leaving women in severe pain and with compromised fertility.
- At this stage we estimate that more than 85% of the women that have contacted us may have claims to run again either Dr Simon Gordon, and/or potentially the Epworth hospital
- Impacted women may be entitled to pursue compensation, This includes the potential to seek compensation for injury, which could include lump sum compensation for medical expenses, lost earnings and pain and suffering. Claimants may also be entitled to punitive or exemplary damages in some cases.
- No amount of money that can properly compensate someone for the loss of their fertility, particularly at such a young age.
- For many women, this is not only a fight for compensation – it’s a fight for truth, accountability, and systemic change
- Dr Simon Gordon has treated over 13,000 women. With already over 150 women reaching out to us, we expect to see these numbers increase.
